RICHMOND, Va. — Bracing for the possibility of violence ahead of a rally to protest efforts to enact sweeping new gun control measures in Virginia, Gov. Ralph Northam on Wednesday declared a state of emergency and announced a temporary ban on weapons on the grounds of the State Capitol.
Thousands of protesters are expected to converge in Richmond on Monday to oppose a series of proposed restrictions on gun purchases expected to be taken up in the coming weeks by the Virginia Legislature, where Democrats control both chambers and the governor’s office for the first time in a generation. For those who have been following the information contained in this thread and elsewhere, this latest news will sound familiar. A state of emergency allows the Governor to access certain resources, like the National Guard, in order to increase the State’s response. Just before 9 p.m. that night, Mayor Tom Bradley called for a state of emergency, and California Gov. Pete Wilson ordered 2,000 National Guard troops to report to the city.
Of course, no mass deployment of that sort ever occurred, but Garden Plot was activated by the Secretary of the Army in April 1992 to help quell the riots in Los Angeles. The Marines ordered to help restore order in Los Angeles with the outbreak of
violence following the Rodney King verdict in 1992 were not the first Marines to
respond to riots in the United States. Following implementation of the FRP, the military must be careful to
perform only tasks assigned by the Federal Emergency Management Agency
(FEMA) and passed through the Defense Coordinating Officer (DCO) to the
Disaster Relief Task Force (DRTF). Otherwise, the military may not be
reimbursed for its expenses. Funding procedures for Civil Disturbance
operations are discussed in the Garden Plot operations plan (OPLAN). Three important legal issues associated with this
coordination are compliance with the Posse Comitatus Act; regulations
concerning the leasing of equipmen; and observing local jurisdictions On the other hand, with very limited exceptions, the Posse
Comitatus Act prohibits military forces from conducting police functions, e.g.,
detaining and arresting people, or conducting surveillance operations of
individuals or groups. In domestic operations, all personnel (and not just the
commanders) need to understand the limits on such actions. Written rules of
engagement (ROE) cards could be an appropriate way to reinforce
predeployment briefings on the limits of the range of military action.
Besides asking the military to help perform certain law-enforcement
activities, the police may also seek to borrow military equipment, such as
night-vision goggles (NVGs). The requirements for such arrangements are
discussed in the Garden Plot OPLAN and 10 USC 2667.
Finally, complying with police lines of jurisdiction will facilitate
coordination with local police. Coordination with the National Guard (NG) varies according to whether
the Guard is under Title 10 or Title 32 jurisdiction. When under Title 10
jurisdiction, the NG is under federal jurisdiction and is part of the federal chain
of command; however, when under Title 32 jurisdiction, NGs are under state
jurisdiction and are part of the state chain of command. The difference in legal
status also affects the types of activities the Guard may perform (e.g., law
enforcement) and whether individual members are subject to the Uniform
Code of Military Justice (UCMJ). Commanders need to be aware of the
implications of Title 10 and Title 32.
During Hurricane Andrew relief, for example, NG troops remained under
state control, thus exempting them from the Posse Comitatus ACT and
permitting them to perform law-enforcement activities. Following the LA
riots, however, the majority of NG forces were federalized, which limited their
freedom of action to support police operations. To confuse the situation, as in
the Los Angeles riots, sometimes not all NG forces are federalized and
sometimes NG forces will shift in the midst of operations from state to federal
and back to state control. So it was that on May 1, 1992, I was an Army National Guard captain leading my first patrol with live ammunition in a real-world mission. With the Governor declaring a state of emergency, lets take a look at how emergency preparedness is handled in order to gain a better understanding of what we will be seeing in Richmond on Lobby Day 2020. Emergency management is often described in terms of “phases,” using terms such as mitigate, prepare,
respond and recover. This paper examines the origins, underlying concepts, variations, limitations, and
implications of the “phases of emergency management.” The purpose is to provide background
information for transportation researchers and practitioners.
The paper looks at definitions and descriptions of each phase or component of emergency management,
the temporal versus functional distinctions of the various phases, the importance of understanding
interrelationships and responsibilities for each phase, some newer language and associated concepts
(e.g., disaster resistance, sustainability, resilience, business continuity, risk management), and the
diversity of research perspectives Emergency management in the United States has been described for the past three decades as a “four
phase” process, involving:
• Mitigation
• Preparedness
• Response
• Recovery
These terms have been widely used by policy makers, practitioners, trainers, educators, and
researchers. The title to this figure refers to the “spectrum of incident management actions,” but the text refers to
“phases.” In this figure, time periods are defined as “pre-incident,” “incident,” and “post-incident.” So is it clear that we are now talking about five phases (or activities, components, aspects), with
“prevention” as the addition? "Disaster" means (i) any man-made disaster including any condition following an attack by any enemy or foreign nation upon the United States resulting in substantial damage of property or injury to persons in the United States and may be by use of bombs, missiles, shell fire, nuclear, radiological, chemical, or biological means or other weapons or by overt paramilitary actions "Emergency" means any occurrence, or threat thereof, whether natural or man-made, which results or may result in substantial injury or harm to the population or substantial damage to or loss of property or natural resources and may involve governmental action beyond that authorized or contemplated by existing law because governmental inaction for the period required to amend the law to meet the exigency would work immediate and irrevocable harm upon the citizens or the environment of the Commonwealth or some clearly defined portion or portions thereof;
"Emergency services" means the preparation for and the carrying out of functions, other than functions for which military forces are primarily responsible, to prevent, minimize and repair injury and damage resulting from disasters, together with all other activities necessary or incidental to the preparation for and carrying out of the foregoing functions. These functions include, without limitation, fire-fighting services, police services, medical and health services, rescue, engineering, warning services, communications, radiological, chemical and other special weapons defense, evacuation of persons from stricken areas, emergency welfare services, emergency transportation, emergency resource management, existing or properly assigned functions of plant protection, temporary restoration of public utility services, and other functions related to civilian protection. These functions also include the administration of approved state and federal disaster recovery and assistance programs; "State of emergency" means the condition declared by the Governor when in his judgment, the threat or actual occurrence of an emergency or a disaster in any part of the Commonwealth is of sufficient severity and magnitude to warrant disaster assistance by the Commonwealth to supplement the efforts and available resources of the several localities, and relief organizations in preventing or alleviating the damage, loss, hardship, or suffering threatened or caused thereby and is so declared by him. Executive orders, to include those declaring a state of emergency and directing evacuation, shall have the force and effect of law and the violation thereof shall be punishable as a Class 1 misdemeanor in every case where the executive order declares that its violation shall have such force and effect. After a state of emergency is declared in another state and the Governor receives a written request for assistance from the executive authority of that state, the Governor may authorize the use in the other state of personnel, equipment, supplies, and materials of the Commonwealth, or of a political subdivision, with the consent of the chief executive officer or governing body of the political subdivision; 17. Coordinate intelligence activities relating to terrorism with the Department of State Police; and ...
Whenever the Governor has declared a state of emergency, each political subdivision within the disaster area may, under the supervision and control of the Governor or his designated representative, control, restrict, allocate or regulate the use, sale, production and distribution of food, fuel, clothing and other commodities, materials, goods, services and resource systems which fall only within the boundaries of that jurisdiction and which do not impact systems affecting adjoining or other political subdivisions, § 44-146.28. Authority of Governor and agencies under his control in declared state of emergency.
A. In the case of a declaration of a state of emergency as defined in § 44-146.16, the Governor is authorized to expend from all funds of the state treasury not constitutionally restricted, a sum sufficient.

Below, a small glimpse of the many groups likely to be present on Lobby Day, 2020. Prominent far-right activists and groups banned from rallying with weapons in Charlottesville, Virginia, after the deadly 2017 “Unite the Right” rally are headed back to the state for a pro-gun rally in Richmond, where tensions are running high. The event has also drawn militia groups from across the country, and plenty of internet chatter that Monday could kick off the “boogaloo”—far-right slang for a violent American revolution or civil war. It’s also drawn in at least four people and organizations who were in Charlottesville on the day of the “Unite the Right” rally when white supremacist James Alex Fields killed counter-protester Heather Heyer with his car. Right-wing internet personality Tammy Lee, for example, has described herself as a Charlottesville rally organizer and is currently barred under a consent agreement with the city from rallying there with weapons. Lee has been promoting an event called “Militias March on Richmond” on Monday, and plans to attend with her group, “Declaration of Restoration.” Far-right internet personality Joshua Shoaff, who has more than 540,000 Facebook fans under the pseudonym “Ace Baker,” has been urging his audience in livestreams to rally in Richmond on Monday. In 2018, Shoaff and his group, American Warrior Revolution, also signed an agreement with the city of Charlottesville that bans them from returning to the city to rally while armed. And so a Nevada-based group called the Oath Keepers said it’s sending training teams to help form posses and militias in Virginia.
The leader of a Georgia militia called Three Percent Security Force has posted videos and calls to arms on Facebook, urging “patriots” to converge on Richmond. PHILADELPHIA (CBS) — Author and filmmaker Dinesh D’Souza weighed in on the recent violence in Charlottesville over the weekend claiming that the organizer of the rally is a supporter of former President Barack Obama and Occupy Wall Street. “The white supremacist leader of this group is an Obama guy and an Occupy Wall Street guy, so right away you know that this could be a sort of staged Nazism that we’re seeing for the benefit of serving a narrative.”

Let's think this through for a moment, you have an "Antifa" group in Richmond planning to join conservatives in protesting the proposed gun control legislation in Virginia. This group is known for their aggressive, sometimes violent protesting and they are planning to join conservatives. Keep in mind, these same people erroneously label conservatives "Nazi's" - otherwise known as National Socialists while simutaneously supporting candidates like the Democratic Socialist Bernie Sanders. The information above suggests the events in Charlottesville also had the very same elements we are seeing reported for the Richmond Lobby Day, with tradtionally radical leftists posing with "conservative" ranks.

Writing a history of concentration camps around the globe, I’ve spent several years looking at how leaders, revolutionaries and military juntas have used “states of exception” — situations in which ordinary laws are deferred or no longer apply. The most notorious example played out between the world wars: Before Adolf Hitler was appointed German chancellor in 1933, Article 48 of the Weimar constitution was invoked more than 100 times, allowing the president to override legislative authority. After his appointment, Nazi leadership employed this extraordinary measure more aggressively to cement Hitler’s use of dictatorial power for more than a decade. Article 23 of Argentina’s constitution allowed for the suspension of constitutional guarantees in the event of domestic disorder. When generals seized power there in 1976, they made intricate, exhaustive use of the article to pervert the legal process. In Chile, a coup on Sept. 11, 1973, institutionalized extrajudicial governance, and the resulting state of emergency remained in place for 15 years. More recently, Myanmar’s fledgling democracy declared a state of emergency over violence in the western state of Rakhine in 2012. The government imposed emergency powers to segregate the Rohingya Muslim population, isolating it behind checkpoints that helped lay the groundwork for ethnic cleansing. States of emergency don’t always require war. The McCarran Internal Security Act, on the books from 1950 until 1971, authorized the president to declare an internal emergency and detain suspected subversives in internment camps

Any democratic government faced with a war, an invasion, a domestic
insurrection, or other type of emergency must determine how it will
respond. How much power will the executive be given? What will be the
role of the other branches of government? How long will the response last?
How will the government administer justice during such a period? What,
if any, fundamental rights will be sacrificed in order to protect the nation?
The way in which a nation responds to such questions will undoubtedly
determine how successful it will be in responding to the crisis with which
it is faced.
The United States, as well as other common law nations, such as Great
Britain, has developed the doctrine of "martial law." Martial law is not
mentioned by name in the U.S. Constitution, nor are any emergency powers explicitly granted to the President.1 This has left development of the
doctrine to the courts. Though no one authoritative definition of "martial
law" has developed, it has been defined by the Supreme Court as follows:
"Martial law is the law of military necessity in the actual presence of war.
It is administered by the general of the army, and is in fact his will. Of
necessity it is arbitrary; but it must be obeyed."'2 At its essence, martial law
is based on the concept of necessity, and provides little limitation on the
use of military power when circumstances require its imposition Despite the institution of martial law on several occasions, the
Supreme Court did not consider a case relating to its imposition until
1848, in Luther v. Borden.'0 8 The Court considered the imposition of martial law in Rhode Island, but dismissed the case as a political question
under the Guarantee Clause in Article IV of the Constitution.'0 9 The substantive issue was only addressed in dicta. Referring specifically to state
imposition of martial law, Chief Justice Taney declared that a state could
impose martial law to combat an insurrection, and the decision as to
whether to do so is left to the state itself. Shortly after the conclusion of the Civil War, the Court heard its second martial law case, Ex parte Milligan.1 1 2 The case arose out of the arrest
of Lambdin Milligan in 1864, a confederate sympathizer in Indiana, while
the state was under martial law. 113 Milligan was tried and convicted by
military commission (tribunals established to try specific persons for specific offenses). 1 1 4 He then filed a writ of habeas corpus in federal court,
disputing the jurisdiction of the military commission. 1'
5 The Lincoln
Administration claimed that Milligan's detention was legal under the
Habeas Act of 1863.116 The Act allowed Lincoln to suspend the writ of
habeas corpus during the Civil War, whenever "public safety may require
it. The
Supreme Court, in rendering a 5-4 decision in Milligan's favor, analyzed
the imposition of martial law in Indiana. The Court held that Milligan, a
civilian, could not be tried by a military commission while the civilian
courts in the jurisdiction remained open.' 20 The court reasoned that in
jurisdictions in which the civilian judicial proceedings are not interrupted,
the authority of the government is not in peril, and thus martial law is not
permitted.' 2 ' As there were no active military operations in Indiana when
martial law was declared, Individual Liberties
The declaration of martial law grants the military broad authority to
"do all acts which are reasonably necessary for the purpose of restoring and maintaining public order." The Code of Federal Regulations allows
the armed forces to "exercise police powers previously inoperative in the
affected area, restore and maintain order ... and initiate necessary relief
efforts."'169 The armed forces are required to inform those in the affected
population of the "rules of conduct and other restrictive measures."170
Though not stated in the Federal Regulations, these include restricting
individuals' movement, imposing punishment through military trials, and
suspending other fundamental rights. 171 Generally, the Supreme Court
has sanctioned some violations of civil liberties, at least during the actual
war or emergency.
Korematsu v. United States173 provides insight into the type of invasion
of civil liberties the Court might uphold once martial law is declared. This interpretation garners further
support from the Milligan opinion, where the Court stated that "martial
law... destroys every guarantee of the Constitution and effectively renders
the military independent of and superior to the civil power."' 76 A military
commander theoretically has the discretion, if exigencies require, "to suspend all civil rights and their remedies, and subject citizens as well as
soldiers to the rule of his will."'1 77 Above, we find that there are many terms used throughout history to describe what are essentially emergency powers. State of seige, martial law, state of emergency, states of exception etc.

It seems that the VA Supreme court has tipped their hand that they will not support the citizen's Right to bear arms. This only adds fuel to the fire, as many will see this as one less avenue to redress of grievances.

It could have been even worse. An earlier version of the bill would, according to one of its cosponsors, Sen. John McCain, Ariz., have allowed the president to use the U.S. military to seize American citizens on the home front and ship them to Guantanamo.
Sen. Lindsey Graham; S.C., cheered the provision, because it would “basically say in law for the first time that the homeland is part of the battlefield.” He added that “I believe our military should be deeply involved in fighting these guys at home.” On December 31, 2011, President Obama signed the National Defense Authorization Act (NDAA), codifying indefinite military detention without charge or trial into law for the first time in American history. The NDAA’s dangerous detention provisions would authorize the president — and all future presidents — to order the military to pick up and indefinitely imprison people captured anywhere in the world, far from any battlefield. Mr. Obama refused to entertain any investigation of the abuses of power under his predecessor, and he has been far too willing to adopt Mr. Bush’s extravagant claims of national secrets to prevent any courthouse accountability for those abuses. This week, he is poised to sign into law terrible new measures that will make indefinite detention and military trials a permanent part of American law.
The measures, contained in the annual military budget bill, will strip the F.B.I., federal prosecutors and federal courts of all or most of their power to arrest and prosecute terrorists and hand it off to the military, which has made clear that it doesn’t want the job. The legislation could also give future presidents the authority to throw American citizens into prison for life without charges or a trial. The bill, championed by Republicans in the House and Senate, In part the National Defense Authorization Act helps to preserve the status quo established a decade ago with the original provisions in the PATRIOT Act giving the government broad new powers in the so-called War on Terror. In part the bill expands those powers, codifying the use of indefinite detention of foreign nationals and possibly US citizens arrested abroad and at home. In part the bill expands the use of the US military on domestic soil, at once complicating anti-terrorism strategies at home and raising serious questions about the role of the military in law enforcement.
All these things should make Americans - and not just Americans - very nervous about the preservation of their civil liberties Yes, the worst things you may have heard about the National Defense Authorization Act, which has formally ended 254 years of democracy in the United States of America, and driven a stake through the heart of the bill of rights, are all really true. The act passed with large margins in both the House and the Senate on the last day of last year – even as tens of thousands of Americans were frantically begging their representatives to secure Americans' habeas corpus rights in the final version.
It does indeed – contrary to the many flatout-false form letters I have seen that both senators and representatives sent to their constituents, misleading them about the fact that the NDAA destroys their due process rights. Under the act, anyone can be described as a 'belligerent". As former Reagan official, now Ron Paul supporter, Bruce Fein points out, on 1 March, we won't just lose the bill of rights; we will lose due process altogether. We will be back at the place where we were, in terms of legal tradition, before the signing of the Magna Carta – when kings could throw people in prison at will, to rot there forever.

If you read the Virginia Governors Executive Order you will find under section A, " Activation of the Virginia Emergency Operations Center." When we visit the official Virginia.gov website for the Virginia Emergency Operations Center we discover the Virginia Emergency Operations Center is comprised of many agencies, including the Virginia Department of Military Affairs. When we visit the official Virginia.gov website for the Virginia Department of Military Affairs we discover they are in fact comprised of the Virginia National Guard and Virginia Defense Force. So the Virginia National Guard has been activated via proxy through the Virginia Emergency Operations Center. This agency is infact made up of several sub agencies, including the Virginia Department of Military Affairs, which is in fact the Virginia National Guard and Virginia Defense Force.

The police are creating a perimeter.
In Charlottesville, the report said, the police actually “generated more violence” by pushing protesters back toward the counterprotesters.
“Fixed checkpoints should be established to allow entry into the secure perimeter, much like the gates to a stadium,” the report said, adding that checkpoints would also allow authorities to prevent protesters from carrying weapons or other prohibited items inside.
That is the plan Virginia officials appear to be following for Monday: They have posted a map on Twitter and Facebook showing just one entrance to Richmond’s Capitol Square, where attendees will be screened for contraband. Some worry that by creating a single point of entry, the authorities could force opposing groups to enter at the same time and possibly lead to violence. Law enforcement officials in Virginia are grappling with a crucial challenge: keeping the opposing groups at the rally separate while ensuring that others — potentially deterred by metal detectors and other security measures — do not flood nearby streets that are not covered by the emergency weapons ban.

Gov. Ralph Northam (D) last week declared a state of emergency and issued a ban on firearms or other weapons on Capitol grounds. The state Supreme Court upheld the ban after a challenge by two gun rights groups. The Federal Aviation Administration has issued temporary flight restrictions for Richmond airspace, making it illegal to fly planes or drones above the city on Monday. Northam has said officials are concerned about threats from weaponized drones.
“Any group that comes to Richmond to spread white supremacist garbage, or any other form of hate, violence, or civil unrest isn’t welcome here,” House Minority Leader Todd Gilbert (R-Shenandoah) said in a written statement Saturday. “While we and our Democratic colleagues may have differences, we are all Virginians and we will stand united in opposition to any threats of violence or civil unrest from any quarter.” Not all of the heated rhetoric has come from outsiders.
Sen. Amanda F. Chase (R-Chesterfield), who plans to speak at the rally, warned on Facebook that authorities might send a troublemaker into the crowd — a “government plant,” she said — to cause a disruption as an excuse to arrest attendees on “domestic terrorist” charges. “The frustrating thing to me is, if something does happen, that’ll be all people talk about,” Van Cleave said. “My view is, we have no control. We’re telling police everything we know about and trusting them to do their job.” State Police have been out in force, providing backup for the Capitol Police, who normally patrol the square. If you read the Virginia Governors Executive Order you will find under section A, " Activation of the Virginia Emergency Operations Center." When we visit the official Virginia.gov website for the Virginia Emergency Operations Center we discover the Virginia Emergency Operations Center is comprised of many agencies, including the Virginia Department of Military Affairs. When we visit the official Virginia.gov website for the Virginia Department of Military Affairs we discover they are in fact comprised of the Virginia National Guard and Virginia Defense Force. So the Virginia National Guard has been activated via proxy through the Virginia Emergency Operations Center. This agency is infact made up of several sub agencies, including the Virginia Department of Military Affairs, which is in fact the Virginia National Guard and Virginia Defense Force. B. Authorization for the heads of executive branch agencies, on behalf of their regulatory boards as appropriate, and with the concurrence of their Cabinet
Secretary, to waive any state requirement or regulation, and enter into contracts
without regard to normal procedures or formalities, and without regard to

The federal government derives its authority for isolation and quarantine from the Commerce Clause of the U.S. Constitution.
Under section 361 of the Public Health Service Act (42 U.S. Code § 264), the U.S. Secretary of Health and Human Services is authorized to take measures to prevent the entry and spread of communicable diseases from foreign countries into the United States and between states.
The authority for carrying out these functions on a daily basis has been delegated to the Centers for Disease Control and Prevention (CDC). As the number of U.S. cases has crept upward (to 11, as of this writing), the federal government has declared a public health emergency, Among the false information that has circulated around the virus: reports that the Federal Emergency Management Agency was proposing martial law to contain the spread; claims that drinking chlorine dioxide, a bleaching agent, would get rid of it; and graphic video footage that claimed to show an infected man vomiting blood on a train. The World Health Organization on Thursday declared the virus outbreak a global emergency. Public health officials say that there continue to be many questions about the virus that need to be answered, including around how easily it spreads and its severity. This uncertainty leaves experts like Johns Hopkins Associate Professor Mark Dredze, who has published research on vaccine misinformation, worried that the misleading claims will continue to spread. In the age of constant threats from new emerging infectious diseases and possible outbreaks all over, martial law is getting that new rising status –a medical one. That means that the uncertain epidemiological future of our world will challenge us with the options of imposing Medical Martial Law to save lives or simply refusing to enact martial law during the outbreak periods and protect freedom and rights, but lose human life.
Medical Martial Law is defined as a special kind of martial law which could be executed in an emergency situation of high alert from infectious disease where epidemic level grows into pandemic on specific geographic areas. In these circumstances, Medical Martial Law becomes the only way to form the quarantine, build a protocol for screening the viral disease and detect the potential infected. It would use a synthetically based bio-surveillance guide based on the outcome of carefully designed epidemiological integration processes.
It seems so simple to declare Medical Martial Law under the explanation that there is no other policy for protecting citizens other than to protect them from themselves. This is the key in opening the door of understanding interests of government in announcing the Medical Martial Law. U.S. Northern Command is executing plans to prepare for a potential pandemic of the novel coronavirus, now called COVID19, according to Navy and Marine Corps service-wide messages issued this week.
An executive order issued by the Joint Staff and approved by Defense Secretary Mark Esper this month directed Northern Command and geographic combatant commanders to initiate pandemic plans, which include ordering commanders to prepare for widespread outbreaks and confining service members with a history of travel to China.
The Navy and Marine Corps messages, issued Tuesday and Wednesday, respectively, reference an executive order directing U.S. Northern Command to implement the Department of Defense Global Campaign plan for Pandemic Influenza and Infectious Diseases 3551-13.

The moment the president declares a “national emergency”—a decision that is entirely within his discretion—more than 100 special provisions become available to him. While many of these tee up reasonable responses to genuine emergencies, some appear dangerously suited to a leader bent on amassing or retaining power. For instance, the president can, with the flick of his pen, activate laws allowing him to shut down many kinds of electronic communications inside the United States or freeze Americans’ bank accounts. Other powers are available even without a declaration of emergency, including laws that allow the president to deploy troops inside the country to subdue domestic unrest. Under this interpretation, Section 706 could effectively function as a “kill switch” in the U.S.—one that would be available to the president the moment he proclaimed a mere threat of war. It could also give the president power to assume control over U.S. internet traffic. The idea of tanks rolling through the streets of U.S. cities seems fundamentally inconsistent with the country’s notions of democracy and freedom. Americans might be surprised, therefore, to learn just how readily the president can deploy troops inside the country. Take Ex parte Milligan, a famous ruling from 1866 invalidating the use of a military commission to try a civilian during the Civil War. The case is widely considered a high-water mark for judicial constraint on executive action. Yet even as the Court held that the president could not use war or emergency as a reason to bypass civilian courts, it noted that martial law—the displacement of civilian authority by the military—would be appropriate in some cases. surveillance, pursuit, interrogation, investigation, evidence collection, security functions,
traffic or crowd control, or similar activities, except in cases and under circumstances

training, or inactive duty training in a Title 10, USC, duty status.
d. The PCA does not apply to NG forces operating in state active duty or Title 32,
USC, status. [color:#FF0000]However, when the NG is operating under a Title 10, USC, status (federal
status), they are subject to the PCA.[/color] The PCA does not restrict the USCG, even when
operating under the USN, due to the USCG having inherent law enforcement authority
under Title 14, USC.
(2) Emergency Authority. Emergency authority should not be confused with
immediate response authority. Federal forces acting under immediate response authority
are still bound by the PCA and may not participate directly in law enforcement. Emergency

authority and actions taken under the Insurrection Act are expressed exceptions to the PCA. The Army Reserve includes substantial capabilities vital in disaster response and stands ready to support lead agencies for domestic emergencies and disaster relief efforts.
10 U.S. Code Section 12304a, amended by the 2012 National Defense Authorization Act provides new authority for the Active and Reserve Components (Title 10) to assist our citizens and communities in the United States during domestic emergencies to save lives, prevent human suffering and mitigate great property damage. By definition, DSCA is support provided in response to requests for assistance from civil authorities for special events, domestic emergencies, designated law enforcement support, and other domestic activities. These categories, in many cases, can overlap or be in effect simultaneously, depending on the particular circumstances of the incident. DSCA may be provided by U.S. Federal military forces, National Guard forces performing duty under Title 32, DoD civilians, DoD contract personnel, and/or DoD units. This final rule establishes policy and assigns responsibilities for DSCA, supplements regulations regarding military support for civilian law enforcement, and sets forth policy guidance for the execution and oversight of DSCA when requested by civil authorities and approved by the appropriate Department of Defense (DoD) authority, or as directed by the President, within the United States In the event of multiple, near simultaneous, geographically dispersed terrorist attacks in the United States, or the rapid spread of a pandemic, it is unknown if Governors would release their National Guard capabilities to support another state or a Federal Agency if there is a chance that resources would be needed in their home states. Many emergencies, disasters, or events affect more than one state. It is not realistic to expect Federal Departments or Agencies to coordinate requests for assistance or support with multiple States, Commonwealths, and Territories. Finally, there are some capabilities that are available only in the Active Duty military force or in DoD. Federal Military Forces. Army, Navy, Marine Corps and Air Force personnel (including Reserve Component personnel) on Federal active duty and National Guard personnel when under Federal command and control.
Immediate Response Authority. A Federal military commander's, DoD Component Head's, and/or responsible DoD civilian official's authority temporarily to employ resources under their control, subject to any supplemental direction provided by higher headquarters, and provide those resources to save lives, prevent human suffering, or mitigate great property damage in response to a request for assistance from a civil authority, under imminently serious conditions when time does not permit approval from a higher authority within the United States. Immediate response authority does not permit actions that would subject civilians to the use of military power that is regulatory, prescriptive, proscriptive, or compulsory. State immediate response is addressed in § 185.4(h) of this part. G. The Department of Defense Civil Disturbance Plans (Pg. 102)
DoD’s Civil Disturbance Operations (CDO) plan was formerly known as “GARDEN PLOT.”51
Since the creation of the Department of Homeland Security and USNORTHCOM, DoD has
delegated to geographic combatant commanders responsibility for developing CDO Contingency
Plans (CONPLANs). “GARDEN PLOT” has since been replaced by the respective COCOM Plans.
These geographic commander CONPLANs provide guidance and direction for planning,
coordinating, and executing military operations during domestic civil disturbances. The last formal Garden Plot plan was Headquarters Deparment of the Army, Department of Domestic Civil Disturbance Plan February 15 1991. There was also a 2001 plan prepared by the US Joint Forces Command, the force provider prior to the existence of NORTHCOM, USINCJFCOM FUNCPLAN 2502-98 Civl Disturbance Plan (FOUO), June 25, 2001, obtained by the author. The 1991 plan replaced Department of the Army plan. The 1984 plan was preceded by OPLAN 55-2, "Garden Plot," 1968 which was employed during the riots of 1967-1971, USNORTHCOM Concept Plan (CONPLAN) 3502 Civil Disturbance Operations, replaced Garden Plot and CONPLAN 2502 Part II of this chapter overviews the historic laws and policies
that are the foundations for defense support to civilian authorities,
particularly in the context of support to law enforcement agencies
and the prevention of or response to civil disorders. This sets the
stage for a non-exhaustive historical assessment in Part III of 20th
and 21st century examples of defense support to civil authorities,
broken down into the eras of: the early to mid-20th Century; mid
to late-20th Century; the late 1970s through early 1990s: and the
so-called “Garden Plot” civil disturbance plan being revisited in
real-world application; That plan, redesignated GARDEN
PLOT in 1967 (and still extant today) proved to be inadequate with
respect to aiding Army commanders in civil disturbance
situations;76 thus, subsequent collection plans (e.g., PUNCH
BLOCK, LANTERN SPIKE), with respect to military
counterintelligence collection and analysis, were separate from
any federal or local law enforcement capabilities.77
The years of 1967 and 1968 were especially significant—and
tragic—with respect to military support to civilian authorities. The
Newark, New Jersey riot response involved elements of the Army’s
108th Military Intelligence Group at Ft. Devens, Massachusetts,
and with the Army largely “limited to observing events The Late 1970s through Early 1990s: Garden Plot Revisited
President Jimmy Carter established the Federal Emergency
Management Agency (FEMA) under the 1978 Reorganization Plan
No. 3, and activated April 1, 1979, by Executive Order 12127.90
Executive Order 12148 shifted disaster relief efforts to the new
federal-level agency, and FEMA gained responsibility from DOD
for the nation’s Civil Defense. Under the 1967 Garden Plot contingency plan, Joint Task
Force (JTF) 140 brought together Army, Navy and Coast Guard
elements, with a contingent from the US Marshals Service and the
FBI, for Operation Hawkeye, FEMA’s first major test of disaster
relief capabilities.94 Military Police, augmented by medical,
engineer, legal and other support personnel enforced a dusk-todawn curfew—but not martial law: they patrolled the island for
two months, securing key installations; worked with the FBI and
the US Marshals to apprehend several hundred escaped prisoners;
intercepted air-dropped bundles of cocaine valued at over $50
million; and carried out extensive training for the Virgin Island
National Guard and conducted joint patrols with the St. Croix
Police Department.95
[b]Six days in early May 1992 were filled with rioting, arson,
murder and mayhem on the streets of Los Angeles following the
controversial acquitting of officers involved in the Rodney King
beating.96 Garden Plot yet again became the contingency plan
under which some 10,000 activated California National Guard
troops served alongside 2,500 Active Component troops, and 1,700
federal law-enforcement officers from different agencies from
across the state to put down disturbances.[/b] The SRUF cancel the Rules for the Use of Force (RUF)in Garden Plot. Garden Plot (the DoD Civil Disturbance Plan) has also been superceded in the United States Northern Command (USNORTHCOM) Area of Responsibility (AOR) by USNORTHCOM Concept Plan (CONPLAN) 3502. Under the Insurrection Act, the President may use the National Guard (when called into Federal service),
reserves (when called to active duty), and members of the Armed Forces to enforce Federal laws or to
suppress the insurrection. DOD has an established protocol, the Commander, U.S. Joint Forces
Command Civil Disturbance Plan (“Garden Plot”). (Page 230)

The President outlined new guidelines for Americans, “including the young and healthy,” including engaging in home education, avoiding gatherings of more than 10, avoiding discretionary travel, and avoiding bars, restaurants and food courts. Nearly seven million people living in a wide swath of Northern California, including Silicon Valley, are being ordered to shelter in place starting at midnight Monday night as authorities try to stop the novel coronavirus from spreading.

The nature of Psychological Operations ( Psy-Ops ) revolves around using deception to influence the battlefield in a favorable manner to achieve strategic military objectives. It doesn't take long to see the consequences of the coronavirus hysteria to understand what some of those strategic military objectives may be. Some of president Trumps new guidelines include avoiding gatherings of more than 10 people, avoiding discretionary travel which is really another way of saying not to go anywhere that you do not have a very good reason for going to, avoiding restaurants, bars food courts etc. Basically anywhere where Americans may be able to discourse among themselves without the need for electronic aid. These are clear violations of the constitution, rights which weren't simply written down without significant hardship aiding in their creation. I am extremely suspicious of the alterior motives behind this COVID-19 outbreak hysteria, with 7-million Americans under shelter in place orders and information suggesting the martial law shelter in place order in San Francisco could end nationwide there are significant plans to undermine freedom and liberty in the United States. With all 50 states declaring a state of emergency, the legal frameworks have been put into place to deploy the National Guard nationwide and with president Trumps national emergency declaration the ability of the president to take a number of steps, including deploying the military further increases the possibility of such an event occurring. The infrastructure for martial law and unspeakable tyranny is being sowed right underneath lady liberty's nose here and the potential consequences could be dire. We have the NY governor requesting the US Army to aid in the coronavirus hysteria and the Pentagon warning military intervention includes "trade offs." What are those trade-offs? We are talking about a loss of constitutionally protected rights. We are talking about a loss of liberty and freedom. I cant think of how a military operation could be more successful than the target population actually welcoming troops into their towns and cities and supporting the efforts to curtail their individual liberty and freedoms. And that is the exact prospect the United States is facing as the increasingly likely possibility of just such an event occurring continues to become a reality. Who remembers when the police confiscated firearms from civilians in New Orleans after Katrina? And if you turn on the television, the mainstream media is bringing out "experts" who are propagandizing Americans to trade freedom for security without a second thought on the possible consequences and ramifications of such medical martial law declarations. And with experimental coronavirus vaccines being trialed in Washington state, it helps to remember the 1917 Spanish Flu influenza and reports that suggest an experimental vaccine was responsible for killing 50-100 million people across the world. I don't know who needs to hear this information, but I would recommend dispersing assets to diversified locations and viewing every piece of information surrounding the coronavirus outbreak hysteria with a healthy dose of skepticism in evaluating what their actual motives may be. With news that the White House is floating a proposal to make immediate cash payments to Americans (wealth redistribution) and Boeing asking for a government Bailout, the nationalization of yet another industry; the United States is paving the way for the Communist takeover of America. In readying the National Guard for action, Newsom’s office emphasized that it’s for duties routinely performed during natural disasters and other emergencies. But Newsom grimly added that “we have the ability to do martial law ... if we feel the necessity.”
Imposing martial law would take the extraordinary step of replacing the usual laws with military authority, with the possible suspension of civil liberties like freedom of association and movement. In their current state-level Title 32 status, the country's 450,000 Guardsmen can be deployed by their governor to transport medical supplies, help with drive-through testing, and assist local law enforcement with enforcing curfews and other tasks, Lengyel said. He advised against federalizing the National Guard under Title 10 — one of the options the administration had been considering — because doing so means the states would lose some of those authorities. Acknowledging that the most difficult question ahead is what role the military will play in keeping order in America, on Thursday Air Force Gen. Joseph Lengyel, head of the National Guard Bureau, cautioned against federalizing the state-based National Guard, which would rob them of their unique legal authorities to conduct law enforcement missions. WASHINGTON -- The latest: President Donald Trump said the United States has enacted the Stafford Act to declare a major disaster response to the coronavirus outbreak. Under the Stafford Act,75 the President may commit federal troops to assist state
governments in their disaster relief operations.76 Under this Act, the President may use
77 military troops to perform work "essential for the preservation oflife and property." It
should be noted, however, that the Stafford Act is not an exception to the Posse Comitatus
Act, primarily because activities under the Act should not involve law enforcement activities It is interesting to note that the Code of Federal Regulations also define martial law. See 32 C.F.R. § 501.4.
It states, in relevant part:
Martial law depends for its justification upon public necessity. Necessity gives rise to its
creation; necessity justifies its exercise; and necessity limits its duration...In most instances
the decision to impose martial law is made by the President, who normally announces his
decision by a proclamation, which usually contains his instructions concerning its exercise
and any limitations thereon...When Federal Armed Forces have been committed in an
objective area in a martial law situation, the population of the affected area will be informed
of the rules of conduct and other restrictive measures the military is authorized to
enforce...Federal Armed Forces ordinarily will exercise police powers previously inoperative
in the affected area, restore and maintain order, insure the essential mechanics of distribution,
transportation, and communication, and initiate necessary relief measures. Martial law is a term that describes the government order of replacing civil rule with the military in a time of war or emergency.
