So House Bill 961 passed the House of Delegates today 51-48. 4 Democrats said no to the proposal but it still passed!

Senator Deeds,

After following the lead up to the House of Delegates passing the Virginia Assault Weapons Ban bill, I sternly agree that you oppose this bill. This would make people felons over night by having pieces of plastic (high capacity magazines) in their possession. Not only that there is visually no data to show that this ban will make people safer in Virginia. Less than 1% of all gun deaths involved a rifle of any kind, in-fact I only read a hand full of cases in Virginia that involved a rifle and any kind. This is taking away our constitutional right to keep and bear arms. There are multiple occasions through out the country where and Assault Weapon is used to defend their family. Once again please oppose House bill 961

Not crazy about the bill but it has been ruled constitutional at the Federal Appeals Court level. All of the Governor's gun safety bills have had similar rulings. If they rule otherwise, we will repeal.

Do not know if this one will pass, however. We got rid of a similar one in the Senate.

Dear Senator Masden,

I urge you to vote against House Bill No. 961 primarily due to, “18.2-308.9. Importation, sale, transfer, etc., of assault firearms prohibited; penalty.” I hope that you share my belief that the vast majority of Virginia’s current, lawful firearm owners demonstrate a very responsible and safe possession and use of their firearms. I believe that law abiding Virginians increase their own safety options with firearms they currently and lawfully possess and, as a group, have added to the security of their homes and neighborhoods across the Commonwealth.

I am deeply concerned that significant and widely impacting changes are occurring to Virginia firearm laws are being made without an open and transparent decision-making using facts, objective research, and empirical evidence. I am at a loss to know of a factual basis for expecting improvements to public safety to be derived from the changes to firearm law. From my perspective, Virginia lawmakers are making changes to firearm law based on emotions and fears of malicious individuals who may use firearms to carry out heinous acts. With the proposed legislation, lawmakers are holding law abiding Virginia firearm owners as responsible for these heinous acts. I have great confidence that crime and criminality statistics support the case that law abiding Virginians safely possess and broadly use all the types of currently lawful firearms and ammunition magazines every day, in very large measure, without incident.

With regards to ammunition, magazine capacity, and public safety, Virginia State Police, and more locally, Fairfax County Police duty officers each carry semi-automatic firearms and ammunition magazines. I am grateful for their presence and ability to respond to crimes, but delays in response is of great concern in cases of violent crime. Each State and Fairfax police uniformed officer is equipped with upwards of 40 to 60 rounds of ammunition. Targets of most Virginia crime are civilian Virginians, and not law enforcement officers. In my view, civilians having semi-automatic firearms with ammunition magazines and 30 rounds is not unreasonable or excessive, particularly if confronted by immediately life-threatening, violent, or potentially armed criminal activity.

With regards to “assault firearms,” semi-automatic rifle designs and features described in the legislation include the most common semi-automatic sporting rifles in the United States, such as the AR-15. Users of AR-15 rifles can readily gain proficiency and aiming accuracy due to the AR-15’s simplicity, ease of being firmly held, a readily configurable stock and grips, and is light weight. For those with special needs, such as the physically impaired or elderly, the AR-15 is readily configured for accessories, lights, optics and other enhancements, and allows tailoring for each individual’s physique, needs, and limitations. There is no clear rationale given for the legislation listing the features of the AR-15 as being unlawful. The changes to firearm law will disproportionately affect law abiding citizens whose needs are best served by the semi-automatic rifle designs akin to the AR-15.

OPPOSE HB 421



URGENT ACTION ITEM

We need to stop Delegate Price's HB 421, which destroys Virginia's firearms preemption law!

Currently gun laws in the Commonwealth are consistent, with the exception of shooting and hunting. Purchase, carry, transport, etc. are the same state statewide.

HB 421 allows localities to control possession, carry, transport, and storage of firearms! This will create a nightmare of confusing gun laws everywhere you go.
