Handgun laws in VA for 18-21 year olds? - 01/20/21 05:48 PM

Hey all. I'll probably phone a FFL tomorrow with the same question, but figured it couldn't hurt to ask here.

As far as I thought, Virginia citizens between 18 and 21 were allowed to possess, transport, and open carry handguns acquired through private sales.

Is that still correct? And can I purchase that handgun for sport (USPSA) through VaGunTrader?

Thanks.

Possession yes, OC no under the new laws. Someone like Agent19 would have more thorough information, shoot him a PM, he's a great dude and way smarter than me

Thanks, I will. Would you know if I can purchase a handgun through VaGunTrader though? Or does that violate one of the background check rules?

I'm not sure if a FFL will transfer to or run a background check on someone 18-21.

Under Federal law a FFL holder can’t sell a person under 21 a handgun.
In VA after the UBC law went into effect The courts have stated 18-20 can still buy a handgun via private sale and not be in violation of the UBC law.

This isn’t legal advice so please confirm on your own Via your attorney, VSP or internet search.

Thanks for the quick reply.

Since VaGunTrader requires sellers to work with a FFL, that means I cannot use this platform, right?

Looks like 18-21 year olds can in fact use this site, as long as the buyer is comfortable with it.

Solved!

Thanks all smile

Oh yeah, OC is legal... for 18-20, even those <18 on their own property.
However, be careful as the old protections of 15.2-915 have pretty much been stripped away.
Imho, all those that choose to carry should know how to go hands on to defend against a gun grab.
Open Carry . .Org was once a great source of info but a lack of moderation and an influx of some disrupting folks has caused its decline.

It's not that you can't use VA Guntrader. It's state law that may cause you issues. The site doesn't require you to use an FFL, the law does.
As said previously though, you may be legally able to, but consult an attorney. Asking a gun shop or a state police trooper may get you several wrong answers.
