Private Sales - 06/08/20 03:16 PM

Recently I was denied a sale of a pistol due to me being 18 and not 21. I have done quite the research on private sales of pistols. To my knowledge and the knowledge of the people I have bought handguns from. It is legal to sell a handgun to a person age 18 and over in the state of Virginia privately. Only FFL’s have the restriction of being 21 to purchase a handgun. Can anyone confirm this, thank you.

Right. 21 is federal law for dealers (18 USC 922(b)(1)). 18 is state law for any sale (§ 18.2-308.7).

You may to hurry though. After July 1 when all transfers must go through FFLs that may deny you a sale before 21. I'm not a lawyer, but that's how it looks to me. Red Ralph strikes again.

That is correct, but some people think they are somehow covering their backside by not selling to anyone under 21. There is no legal issue with it.

Maybe its not a legal issue but a moral issue. I wont sell a handgun to a 18 year old either. It feels like a bad thing to do for some reason. I do feel like anyone should be able to protect themselves and support all who do so I guess I'm a hypocrite

What is immoral about it?

Completely legal to sell a pistol to an 18yo.

Unfortunetly the NRA has supported "background checks" so many gunowners are leery of selling guns that wouldn't pass a FFL style sale.

Maybe that's it, if you cant legally buy it from a FFL I don't want to sell it to you. I wont buy cigarettes for a 20 year old because legally they cant buy them. Even tho a year ago they could, I dont want any trouble with the law. It's legal to sell a 18 year old a gun but what's the rules on a 18 year old carrying a handgun or transporting in a motor vehicle and will I be liable if he or she gets in trouble right after buying it from me. I will be know as the scumbag who sold their 18 yr old a glock on news channel 3. You have to be 21 to rent a car, get a decent hotel room, smoke cigs, drink alcohol and so on. Is there a reason for this age limit? Yes you can join the military at 18 but most police agencies have a 21+ age minimum. At the end of the day to each there own opinion. It might boil down to maturity imo.

I would prefer freedom to make the choice.Nobody wants to sell to a bad person. Not all 18 year old kids are bad.We won't have a choice if we don't vote.Sad to think that most are sheep and will give up their freedom for false security.Bad people will always be here.We can only hope the good people will stop them.
If you can put your life to defend our country you should have the same rights and so should your kids.

It's immoral to him because his god is the state. The state has spoken, and told him that to sell a firearm to anyone younger than 21, it's bad.

So, he is just following his orders.

You know me so well. Your opinion is as worthless as mine. My God has nothing to do with this and my state is just where I live. I do what I want, whether you like it or not.

If an 18 year old can be issued a rifle and fight for his country with his life on the line, then there's nothing "immoral" about an 18 year old wanting to buy a handgun to defend himself, his property, and his family at home. I support it.

Contact VCDL.

They are looking for cases just like yours to push lawsuits.

If you're responding to the original poster, there was nothing lawsuit worthy. Being a Fudd isn't against the law.
